Terms of Service
C & R Cooling & Heating LLC
Last updated: October 24, 2026
These Terms of Service apply to this website and to HVAC services provided by C & R Cooling & Heating LLC ("C & R," "we," "us"), a Florida licensed mechanical contractor, License #CAC1818010. By using this site or scheduling service with us, you agree to these terms. If a written estimate, invoice, contract or plan agreement you sign with us says something different, that written document controls for that job.
1. Information on this website
Everything on this site is general information about HVAC systems and our services. It is not a quote, a warranty or professional advice for your specific equipment. Troubleshooting tips are offered as a courtesy. If you choose to follow them, you do so at your own risk. Never open electrical panels or equipment covers. Photos show past work and are for illustration only. We may update or remove content at any time without notice.
2. Estimates and pricing
- Estimates for new systems, replacements, duct work and new construction are free.
- Repair and service calls have a diagnostic fee: $95 on weekdays before 5pm, $150 after 5pm and on weekends. We'll tell you the fee before we come out. Repair work is quoted separately and only done with your approval.
- An estimate is based on the conditions we can see and reasonably access at the time. Hidden or unforeseen conditions, such as concealed damage, code deficiencies, failed existing components, mold, water damage or structural and electrical issues, may change the scope and price. We won't do extra work without your approval.
- Estimates are good for the period written on them. After that, prices may change with equipment and material costs.
- Any prices shown on this website are subject to change and don't replace a written estimate.
3. Scheduling and availability
We're available 24 hours a day, 6 days a week, but arrival times are estimates and not guarantees. Weather, traffic, call volume, parts availability, permits, inspections and other things outside our control can cause delays. We are not responsible for losses caused by a delay in service.
4. Payment
- Payment is due as stated on your estimate, invoice or agreement.
- Unpaid balances may be subject to collection costs and reasonable attorney's fees as allowed by law.
- Equipment and materials remain our property until paid in full, to the extent allowed by law.
- For improvements to real property, Florida's Construction Lien Law (Chapter 713, Florida Statutes) may apply. Where required, we'll provide the notices that law calls for.
5. Warranties
- New equipment carries the manufacturer's warranty. Many manufacturers require the owner to register the equipment within a set time after install to receive full coverage. Registration is the owner's responsibility unless we agree in writing to handle it.
- Any workmanship warranty we offer is only what is written on your invoice or agreement.
- Warranties don't cover damage from misuse, neglect, lack of maintenance, dirty filters, clogged drains not serviced by us, work by others, power surges, lightning, flooding, storms, pests or other acts of nature.
- Except as stated in writing, and to the fullest extent allowed by law, we make no other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose.
6. C&R ComfortCare maintenance plan
ComfortCare memberships are governed by the signed ComfortCare Membership Agreement, which controls over this summary and over anything on this website. In short:
- $211 per year, per system, paid once at signing or at the first visit. Each additional system needs its own membership.
- The term is 12 months and does not renew automatically.
- Two tune-ups per term, scheduled in whatever months work for the customer. A one-time tune-up without the plan is $150. One standard size pleated filter is supplied and installed per visit. Extra filters you have on site are installed at no labor charge. Specialty or non-standard filters are quoted separately. Quarterly service is available for an added charge.
- Maintenance is preventive and is not a warranty, service contract or insurance. It does not guarantee your equipment won't fail.
- Parts, refrigerant beyond a charge check, repairs, duct cleaning, indoor air quality products and work outside the listed scope are not included and are quoted before any work is done.
- Members receive priority scheduling and discounted repair labor for the life of the agreement. Discounts apply to labor only.
- If we can't access the equipment, we'll reschedule once at no charge. A second missed visit for lack of access counts as completed. Unused visits are forfeited.
- Either party may cancel with 30 days written notice. A full refund is given if you cancel before the first visit. No refund is owed after the first visit.
- Returned or declined payments are subject to a $35 fee plus any bank charges.
7. Your responsibilities
- Provide safe, clear access to equipment, including attics, closets, roofs and outdoor units, and secure pets during the visit.
- Tell us about any known hazards, past repairs or problems with the system.
- Have an adult (18 or older) with authority to approve work present, unless we agree otherwise.
- Change filters between visits, keep the outdoor unit clear and call us promptly if you notice a problem.
8. Existing conditions and hazardous materials
We are not responsible for conditions that existed before our work, including existing ductwork, wiring, drain lines, framing, roofing or drywall that are outside the agreed scope. Cutting and patching for access, and cosmetic repairs, are not included unless stated in writing. We don't test for or remove asbestos, lead, mold or other hazardous materials. If we find them, we may stop work until they are handled by a qualified professional.
9. Limitation of liability
To the fullest extent allowed by law, C & R is not liable for indirect, incidental, special or consequential damages, including lost profits, lost business, spoiled food or inventory, temporary housing or property damage that results from equipment failure we did not cause. Our total liability for any claim is capped at the total price paid to C & R for the specific job the claim relates to. Nothing in these terms limits liability that can't be limited under Florida law.
10. Photos of our work
We may photograph equipment and completed work for our records and for marketing, including this website and our social media. We don't post addresses or personal information. If you'd rather we not photograph your job, just tell us.
11. Links to other sites
This site links to outside sites like Facebook, TikTok and Google Maps. We don't control those sites and aren't responsible for their content or privacy practices.
12. Governing law
These terms are governed by the laws of the State of Florida. Any dispute will be handled in the state courts for the county where the work was performed.
13. Changes to these terms
We may update these terms from time to time. The date at the top shows the latest version. Continued use of this site or our services means you accept the updated terms.
